Resumption of Filing of MVPD Incentive Auction Reimbursement Form (FCC Form 2100 – Schedule 399) Forms Now Due: August 25, 2017

The Federal Communications Commission (“FCC”) has re-opened its Licensing Management System in order for Multichannel Video Programming Distributors (“MVPDs”) to file reimbursement cost estimates for costs incurred from their carrying signals of stations relocating to new channels as part of the Incentive Auction repacking process.  MVPDs that have not yet submitted their Form 399 can do so through 11:59 p.m. EDT on Friday, August 25, 2017.  Please note this is a mechanism whereby MVPD/cable operators can get reimbursed by the federal government for costs associated with channel relocation. 
The FCC Media Bureau will subsequently review reimbursement estimates, after which time an ‘initial allocation’ will be made for eligible entities.  For MVPDs, the initial allocation will account for up to 80% of their estimated costs.  The FCC will release the percentage of cost estimates for MVPDs, commercial stations and noncommercial stations via a public notice.  Additional allocations will account for any adjustments to cost estimates and will be announced via public notice.
According to the FCC, the majority of MVPD cost estimates were successfully submitted or manually reported to the FCC prior to the July 12, 2017 system interruption, and have already been included in the FCC’s tally of total initial cost estimates for the program.
