FCC Announces MTE Compliance Dates for Contracts, Marketing Materials

In February 2022, the Federal Communications Commission released the 2022 Multiple Tenant Environments (MTE) Order (“MTE Order”), which adopted rules prohibiting service providers from entering into or enforcing exclusive and graduated revenue sharing agreements with MTE owners, as well rules requiring providers to disclose the existence of exclusive marketing arrangements in MTE’s. The FCC’s Wireline Competition Bureau has now announced compliance dates for certain requirements in the MTE Order. Specifically, for new contracts with exclusive marketing arrangements, compliance with disclosure rules is required immediately. For existing contracts, compliance is required by September 26, 2022.

If your company has revenue or marketing agreements with an owner of an MTE, an HOA or a developer, we strongly encourage you to look at these new requirements to ensure that existing and future contracts, as well as marketing materials, are compliant.
