FCC Establishes Pleading Cycle in T-Mobile/Sprint Proceeding

Petitions to Deny must be filed by August 27, 2018

As many of you may know, T-Mobile and Sprint filed applications seeking Commission consent to transfer control of licenses, authorizations and spectrum leases to each other as part of their plan to merge. Yesterday, the FCC released a Public Notice establishing the pleading cycle for this proceeding.  The important dates are as follows:  Petitions to Deny must be filed by August 27, 2018; Oppositions must be filed by September 17, 2018, and Replies must be filed by October 9, 2018.  Given the potential consolidation of national competitors and the large amount of spectrum a combined T-Mobile and Sprint would control (including licenses in the 600 MHz, PCS, AWS and 2.5 GHz band), many interested parties may look to file a Petition to Deny or ask for conditions should the merger be approved.
