Common Carrier Annual Employment Report

Common carrier licensees or permittees with sixteen (16) or more full-time employees must file an annual employment report (FCC Form 395) with the Federal Communications Commission by May 31st of each year.

If the filing concerns a licensee that had fewer than sixteen (16) full-time employees during the selected payroll period, no Form 395 filing is required.  Such licensees, however, may fill in Sections I, IV, and V of the report and submit it to comply with current reporting obligations.  If the filing concerns a licensee that had 16 or more full-time employees during the selected payroll period, all sections of the report should be completed.

All common carrier licensees and permittees, regardless of the number of employees, are required to file a report of equal employment opportunity discrimination complaints brought against them.  The discrimination complaint requirement can be satisfied by completing Section IV of the Form 395.

All Form 395 Reports, including resubmissions, must be filed in WC Docket No. 16-233 using the Commission’s Electronic Comment Filing System (ECFS).  The FCC no longer accepts submissions by facsimile or through the Secretary’s Office (except confidential filings).
